The NSW Government is proposing to introduce legislation that removes many of our state's long held environmental protections. The proposal is currently on exhibition to 28 June.

The proposed regime will result in more land clearing across NSW including urban areas. As the legislation heavily relies on a biodiversity offsets policy based on the standards of the problematic Major Projects Offsets Policy, this will see a repeat of the problems experienced with the light rail project, where despite a revegeration program there is a signficant net loss in urban tree canopy.

The NSW Government is proposing new legislation that removes many of our state's long held environmental protections.  The proposal is currently on exhibition to 28 June.

I am writing to you to seek your help as the proposed legislation is a retrograde step for NSW, with the new provisions less stringent, less evidence based and less accountable. This will see land clearing in NSW increase at the detriment to our environment and that for future generations.

In particular, the proposed biodiversity offsets scheme adopts the standards for the Major Projects Offset Policy, which means that the assessment methodology is significantly weakened.  This will see more situations, where there is a significant net loss in urban canopy, as is the case for Sydney's CBD/SE light project.

Further, the proposed regime places a reliance on budgetary decisions rather than protections to prevent a biodiversity decline. In addition, there is no guarantee that proper consultation processes need to be followed, and the proposed structural governance departs from the key recommendation made by the independent Biodiversity Legislation Review Panel.
